These Terms of Service (“Terms”) govern your use of the website and services offered by Medalist Moving Services (“Medalist,” “Company,” “we,” “us,” or “our”).

Our website, located at medalistmoving.com (the “Website”), provides information regarding moving services, moving estimates, quote requests, and related services.

By accessing or using the Website, you agree to these Terms with respect to your use of the Website. When you submit a quote request or otherwise request services from Medalist, additional disclosures, consents, estimates, agreements, or carrier documents may apply.

1. Acceptance of Terms

By accessing or using the Website, you acknowledge that you have read and understand these Terms and our Privacy Policy.

Your use of the Website is subject to these Terms.

Certain services, quote requests, communications, moving arrangements, estimates, or transactions may require additional agreements or affirmative consent. Where additional consent is required by applicable law, these Terms do not substitute for that consent.

2. Eligibility

You must be at least 18 years old to request services through the Website.

If you use the Website on behalf of a company or other organization, you represent that you have authority to act on behalf of that organization.

3. Our Services and Broker Role

Medalist Moving Services operates as an interstate household-goods broker.

Medalist arranges and coordinates transportation services between customers and properly registered or authorized motor carriers.

Medalist is not a motor carrier and does not itself transport, load, unload, or take possession of customers’ household goods.

The motor carrier assigned to perform transportation services is responsible for the physical transportation of the shipment and performs those services pursuant to the carrier’s applicable estimate, tariff, bill of lading, service terms, and other transportation documents.

Services provided by Medalist may include:

Responding to moving inquiries
Preparing or coordinating moving estimates
Assisting customers with move planning
Arranging transportation with motor carriers
Coordinating scheduling and service details
Providing customer support
Communicating by telephone, text message, and email

FMCSA distinguishes household-goods brokers from motor carriers in this same manner: brokers arrange transportation but are not authorized to transport the customer’s household goods themselves.

4. Moving Estimates and Carrier Services

Information submitted through the Website may be used to prepare or coordinate an estimate for moving services.

Estimates may be based on information including:

Pickup and delivery locations
Moving date
Inventory or shipment size
Requested packing services
Storage requirements
Access conditions
Additional services
Information supplied by the customer

You are responsible for providing accurate and complete information.

Website calculations, preliminary quotes, advertising prices, or initial pricing discussions should not be understood as replacing the written estimate or transportation documents applicable to your move.

Where an estimate is provided on behalf of a motor carrier, applicable estimates must comply with governing transportation requirements and the carrier’s applicable tariff and agreements. FMCSA states that brokers may provide estimates on behalf of carriers when the applicable requirements and written broker-carrier agreements are satisfied.

The transporting carrier may require additional documentation before performing transportation services.

Nothing in these Terms modifies or replaces:

A carrier’s written estimate
Bill of lading
Applicable tariff
Valuation or liability election
Inventory
Accessorial-service documents
Claims procedures
Other transportation documents required by applicable law

If these Website Terms conflict with legally controlling transportation documents concerning the actual transportation of household goods, those transportation documents and applicable law will control with respect to that transportation service.

5. Quote Requests and Communications

When you submit a quote request, request information, contact Medalist, or otherwise ask us to communicate with you, you authorize us to respond using the contact information you provide, subject to applicable law and any consent disclosures presented when your information is collected.

Scheduling

Requested services
Customer support
Service availability
Follow-up regarding your inquiry
Promotional offers where legally permitted and appropriately consented to

We may contact you by telephone, text message, or email depending on the contact information and communication preferences you provide.

6. Automated Calling and Telecommunications Technology

Medalist uses telecommunications and software systems designed to respond efficiently to customer quote and information requests.

When you submit a telephone number and request contact, our systems may use automated technologies to assist with contacting you.

Depending on the technology being used, this may include:

Automated selection or dialing of telephone numbers
Immediate outbound calling following submission of a quote request
Call-answer detection
Automated or prerecorded connection messages
Artificial or prerecorded voice technology where applicable
Call routing and transfer technology
Routing calls to available Medalist representatives
Scheduling calls submitted outside applicable calling periods
Callback routing
Duplicate-contact prevention
Selection of Medalist business telephone numbers used to place or route calls

Calls may originate from different Medalist business telephone numbers depending on geographic, telecommunications, or routing requirements. Return calls to numbers used by Medalist may be routed through communications systems to Medalist or its representatives.

Our current FastCall integration specifically accepts a lead for immediate outbound calling and live-answer routing.

Communication Consent

Where federal or state law requires prior express consent or prior express written consent for a particular communication technology, Medalist will rely upon the applicable consent obtained when your contact information is collected.

These Terms and our Privacy Policy do not, by themselves, constitute consent where applicable law requires separate affirmative consent.

Where legally required, consent to receive marketing communications using regulated automated, artificial-voice, prerecorded-voice, or similar technology is not a condition of purchasing goods or services.

The FCC has confirmed that calls using artificial or prerecorded voices, including certain AI-generated voices, remain subject to TCPA consent and disclosure requirements.

Opting Out

You may request that Medalist stop non-essential telephone communications at any time by telling a representative that you do not wish to receive additional calls.

For text messages, you may reply STOP where applicable.

Florida law prohibits continuing outbound telephone solicitations to a consumer who has previously communicated that they do not wish to receive them. Florida also regulates automated dialing, caller-ID transmission, and prerecorded-message calls.

Medalist will process communication preferences and do-not-contact requests in accordance with applicable law.

7. User Obligations

When using the Website or requesting services, you agree to:

Provide accurate, current, and complete information.
Provide telephone numbers and email addresses that you are authorized to use.
Provide accurate information regarding your shipment and requested services.
Notify Medalist if material details concerning your move change.
Use the Website only for lawful purposes.
Avoid submitting false, fraudulent, or misleading quote requests.
Comply with applicable laws and contractual obligations.

Changes to inventory, access conditions, locations, requested services, dates, or other material information may affect pricing or service availability.

8. Prohibited Conduct

You may not:

Interfere with or disrupt the Website or its systems.
Attempt to bypass authentication or security measures.
Introduce malicious software or code.
Use automated systems to submit fraudulent or excessive requests.
Impersonate another individual.
Submit contact information belonging to another person without authorization.
Engage in fraud or deceptive conduct.
Violate another person’s intellectual-property, privacy, or legal rights.
Use the Website for unlawful purposes.

9. Intellectual Property Rights

All Website content, including text, graphics, logos, designs, trademarks, photographs, software, and other materials, is owned by Medalist Moving Services or its licensors unless otherwise stated.

You are granted a limited, revocable, non-exclusive, non-transferable license to access the Website for personal or legitimate business use.

You may not reproduce, distribute, modify, sell, republish, or create derivative works from Website content without authorization except where permitted by law.

10. Third-Party Services and Technology Providers

Medalist may use third-party service providers to operate its Website and business.

These providers may include companies providing:

11. Disclaimers

To the maximum extent permitted by law, the Website is provided on an “as is” and “as available” basis.

Medalist does not warrant that:

The Website will always be uninterrupted or error-free.
Information presented on the Website will always be complete or current.
A particular carrier will be available for every requested date or route.
A preliminary Website quote will represent the final transportation charge.

Information provided on the Website is for general informational purposes and does not constitute legal, tax, financial, or other professional advice.

Nothing in this section limits rights that cannot lawfully be waived.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Medalist Moving Services and its officers, employees, contractors, agents, and affiliates will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the Website.

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited.

To the extent permitted by law, Medalist’s liability arising solely from use of the Website shall not exceed the amount paid directly to Medalist in connection with the transaction giving rise to the claim.

This limitation does not alter rights or remedies arising under applicable federal or state transportation law or a motor carrier’s legally controlling transportation documents.

13. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Medalist Moving Services and its officers, employees, agents, and affiliates from claims, damages, liabilities, and reasonable expenses arising from:

Your unlawful use of the Website
Materially false information you knowingly provide
Your violation of these Terms
Your infringement of another person’s rights

This provision does not require a consumer to indemnify Medalist for Medalist’s own unlawful conduct where such a requirement would be prohibited by law.

14. Dispute Resolution

A. Informal Resolution

Before initiating arbitration, either party may provide the other with written notice describing the dispute and requested resolution.

The parties will make reasonable efforts to resolve the dispute informally for at least 30 days after receipt of the notice.

B. Individual Arbitration

Except for disputes that qualify for small-claims court or claims that applicable law does not permit to be arbitrated, disputes arising from these Terms, the Website, or Medalist’s brokerage services shall be resolved through individual binding arbitration.

Consumer Disputes

For disputes involving an individual consumer using Medalist services for personal, family, or household purposes, arbitration shall be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules and Mediation Procedures, as modified by these Terms and applicable law.

AAA specifically identifies its Consumer Arbitration Rules as the rules governing disputes between individual consumers and businesses.

Commercial Business Disputes

If services are purchased by a business entity primarily for commercial purposes, the parties may use the applicable AAA Commercial Arbitration Rules, unless another written agreement governs the dispute.

C. Arbitration Location and Participation

Unless the parties agree otherwise or AAA rules or applicable law require another procedure, arbitration involving Medalist shall be associated with Palm Beach County, Florida.

The arbitrator may permit hearings by telephone, video conference, documents-only procedures, or other methods allowed by applicable rules.

D. Arbitration Fees and Costs

Arbitration filing fees, administrative fees, and arbitrator compensation shall be allocated in accordance with the applicable AAA rules and applicable law.

Nothing in these Terms requires a consumer to pay amounts that AAA rules or applicable law require Medalist to pay.

Each party is responsible for its own attorneys’ fees unless an applicable law, arbitration rule, or enforceable contractual provision authorizes an award of attorneys’ fees.

This is preferable to your current provision requiring both parties to share administrative costs equally because AAA’s consumer program has its own consumer/business fee allocation.

E. Small Claims Court

Either party may pursue an individual claim in a court of competent jurisdiction that qualifies as small claims court if the dispute remains within that court’s jurisdiction.

F. Class and Representative Action Waiver

To the fullest extent permitted by law, disputes subject to arbitration shall be resolved on an individual basis and not through a class, collective, consolidated, or representative proceeding.

If applicable law prohibits enforcement of this waiver for a particular claim or remedy, that limitation shall apply only to the extent required by law.

G. Arbitration Award

The arbitrator’s award shall be final and binding except to the extent review is available under applicable arbitration law.

Judgment on an arbitration award may be entered in any court having jurisdiction.

H. Survival

This dispute-resolution section survives termination of these Terms and the conclusion of a transaction with Medalist.

15. Governing Law

These Terms are governed by applicable federal law and, to the extent state law applies, the laws of the State of Florida, without regard to conflict-of-law principles.

For disputes that are not subject to arbitration, actions seeking enforcement of an arbitration award, or other proceedings properly heard by a court, venue shall lie in a court of competent jurisdiction in Palm Beach County, Florida, except where applicable law requires otherwise.

This resolves the contradiction in the existing Terms between mandatory arbitration and an “exclusive courts” provision.

16. Changes to Terms

Medalist may modify these Terms periodically to reflect changes in services, technology, legal requirements, or business practices.

When material changes are made, the Last Updated date at the top of these Terms will be revised.

Changes will apply prospectively unless applicable law permits otherwise.

Your continued use of the Website after revised Terms become effective constitutes acceptance with respect to continued Website use. Material changes affecting an existing contractual relationship will be handled as required by applicable law.
